Welcome to Shiv Shakti Digiworld. These Terms and Conditions govern your relationship, projects, and transactions with us. By accessing our platform, hiring our services, or purchasing automation licenses, you legally agree to comply with all rules stated below.

1. Definition of Terms

* "Company", "We", "Us": Refers strictly to Shiv Shakti Digiworld and its verified sub-brands (including Wapibotix).
* "Client", "User", "You": Refers to any business entity, individual, or merchant booking our services or deploying our tech software.

2. Mandatory KYC Verification Policy

To comply with fraud prevention guidelines and maintain secure digital operations, every customer is strictly required to submit valid KYC (Know Your Customer) documents before any project setup, server deployment, or Meta API registration begins.

  • Required Documents: Individual Identity Proof (Aadhar Card / PAN Card / Passport) and Business Proof (GST Registration Certificate, MSME Certificate, or Official Business Registration), along with active contact details.
  • Verification Failure: If a client fails to provide legitimate KYC details, or submits fake documentation, Shiv Shakti Digiworld reserves the strict right to instantly terminate the service without any liability or refund.

3. Project Scope & Delivery

All tech development, local SEO optimizations, and digital marketing setups are carried out strictly according to the mutually frozen Scope of Work (SOW) or digital quotes. Any structural modifications, extra plugin integrations, or design changes requested later will incur additional hourly or project fees.

4. Payments, Settlements & Refund Rules

  • An advance commitment deposit (as detailed in your official quote) must be processed before we trigger code development or marketing workflows.
  • All final project outputs, credentials, and access management roles will be shared only after the outstanding balance is completely cleared.
  • Payments made toward operational expenditures, setup milestones, and active API servers are strictly non-refundable under any normal circumstances.

5. Meta API & WhatsApp Automation (Wapibotix)

For WhatsApp business solutions run under our official brand Wapibotix:

  • Clients must strictly align with Meta’s WhatsApp Commerce Policy. Sending unrequested bulk messages or spam broadcasts is strictly prohibited.
  • If Meta flags, restricts, or completely bans your WhatsApp Business Account (WABA) or phone number due to high spam reports, Shiv Shakti Digiworld holds zero liability, and active tech subscriptions will not be refunded.

6. Intellectual Property Rights

All core frameworks, customized scripts, and design templates engineered by us remain our proprietary asset until the final payments are settled. Upon complete clearance of all financial dues, full ownership rights of the custom deliverables are officially transferred to the client.

7. Limitation of Liability

Shiv Shakti Digiworld will not be held accountable for any unexpected server breakdowns, third-party hosting downtimes, variations in search engine algorithms (Google Maps rankings), or direct business financial losses resulting from live advertising setups.

8. Governing Law & Dispute Resolution

These terms are governed explicitly by the laws of India. Any legal friction, claims, or contract disputes arising from our services will be subject exclusively to the absolute jurisdiction of the courts located in Kota, Rajasthan.
